DOOS & Wheego Car Rental Agreement

Operating under the brands DOOS and Wheego

1. Definitions

Damage: Any impairment, defect, or disfigurement reducing the vehicle’s optimal operating condition, not existing prior to rental.

Loss: Loss of the Vehicle, its parts, accessories, contents, or keys, where such property was in the custody of the Company or the Renter before rental commenced.

CDW/SCDW: Collision Damage Waiver / Super Collision Damage Waiver.

Vehicle Renter: Includes the primary driver, customer, and any Additional Driver.

1.1 Agreement to Terms Without Signature

By proceeding with payment for the rental or booking, the Vehicle Renter expressly acknowledges and agrees to be bound by all terms and conditions of this Agreement, whether or not the Vehicle Renter physically signs a copy. Payment is considered conclusive evidence of acceptance.

2. Payment

– Non-refundable booking fee required for confirmation.
– Full rental payment due before collection (Credit Card only).
– Refundable Security Deposit required at collection (credit card or online transfer within Malaysia). Refunds processed within 50 business days after return, minus charges for damages, repairs, fines, or admin fees.
– Company may transfer fines into Renter’s name or charge debit/credit card if received after deposit refund.

3. Delivery & Collection

– Vehicles must be returned to the pickup location unless otherwise arranged.
– Delivery and collection available on request, subject to charges.
– Fees for different return location vary by vehicle type and distance.
– Drivers will wait max 15 minutes; after that, delivery is considered cancelled.

4. Identification & Additional Drivers

– Valid photo ID (passport/national ID) and driver’s license in English or with certified translation required.
– Foreign nationals must hold an International Driving Permit.
– False info requires cancellation and rebooking at Renter’s cost.
– Additional Drivers must be present at pickup with valid ID.
– Renter must inspect the vehicle and record photos/videos of pre-existing damage.
– No refund if documentation is invalid at collection.

5. Lost & Found

The Company is not liable for personal belongings left in the Vehicle. Recovery efforts are courtesy only and not guaranteed.

6. Fuel & Early Return

– Vehicles must be returned with same fuel level. Refuelling fees apply (see Schedule A).
– No refund for early returns once rental has begun.

7. Usage

– Only Renter/approved Additional Drivers may operate the Vehicle.
– Vehicles may not be used for illegal activity, off-road, ride-hailing, delivery, or commercial use without consent.
– Must obey Malaysian traffic laws (50 km/h city, 110 km/h highway).
– Wrong fuel, negligence, or unauthorized use may forfeit deposit and terminate rental.

8. Loss or Damage

– Renter responsible for timely, undamaged return.
– All accidents/damages must be reported immediately; failure makes Renter liable.
– Without CDW/SCDW, Renter pays full repair and rental charges while unavailable.
– Repairs only at authorized workshops.
– Major accident/total loss: renter liable until insurer compensates or repair complete.
– Key loss, excessive dirt/odors, or impound incur fees (see Schedule A).
– Late payments: 10% compound daily interest.
– Minimum damage fee applies (see Schedule A).

9. CDW, SCDW & Insurance

– All Vehicles are insured.
– CDW/SCDW reduce liability but exclude damages to tires, rims, glass, interior, undercarriage, roof, belongings, lost keys, towing not accident-related, reckless driving, intoxication, unauthorized drivers, cross-border use.
– CDW/SCDW can only be purchased at rental start.

10. Accidents

– All accidents must be reported immediately.
– Unauthorized tow services prohibited; costs fall on Renter.
– Renter must gather details of all parties/witnesses.
– Vehicle must not be abandoned.
– Without Super CDW, Renter fully liable for theft/damage/loss of use.
– Some damages excluded even with Super CDW: wrong fuel, burst tyres, electrical, interior, accessories, underbody/roof damage.

11. Breakdown Support

– Call 24-hour helpline: +6011-5699-2817 / +6012-9221-110.
– Replacement Vehicle may be provided subject to availability.
– Negligence (tyres, lost keys, dead batteries) costs borne by Renter + surcharges (see Schedule A).

12. Rental Alternatives & Cancellation

– Company may cancel rentals anytime, offering alternatives.
– Declining alternative = full refund.
– Company may terminate rentals for safety/operational reasons.
– No refund for early returns by Renter.
– Cancellation within 24h of pickup incurs fixed fee (see Schedule A).

13. Late Payment & Retrieval

– Unpaid rentals 2h past due may lead to retrieval at Renter’s expense (see Schedule A).
– Delinquent accounts reported to RAMCI/CTOS.
– Rental rates may be adjusted to daily rates for overdue payments.

14. Unlimited Mileage

– Rentals include unlimited mileage for ordinary use.
– Abuse (e.g., commercial use without consent) may cause:
1) RM2/km retroactive charges, or
2) Immediate termination without refund.

15. Exchange Rate

Company determines foreign currency exchange rates via chosen financial institutions. Renter accepts applied rate for all transactions.

16. Rental Extensions

– Requires 24h notice and approval.
– Subject to availability.
– Extension rates may differ.

17. Marketing & Data Use

– Applies to current and all future rentals.
– Renter consents to marketing via email/SMS.
– Company may charge for special vehicle use outside standard areas.

18. Credit Reporting & Data Consent

– Renter consents to CTOS/trade checks for account management, debt recovery, and credit evaluation.
– Data may be processed in Malaysia or abroad.
– PDPA compliance assured.

19. GPS & Telematics

– Vehicles are equipped with GPS/telematics.
– Dangerous driving or tampering may result in penalties deducted from deposit.
