Terms & Conditions Disclaimer
From here on forth, JALAL CREATIVE SOLUTION SDN BHD shall be referred to as JALAL CREATIVE and/or the AUTHORISER. From here on forth, the RENTER/ CUSTOMER/PRIMARY/ DRIVER and ADDITIONAL DRIVER(S) shall be referred to as THE VEHICLE RENTER. From here on forth, DAMAGE shall be interpreted as any disfigurement and/or inability of the vehicle to operate in its optimal state that was not present before the handing over of the vehicle to THE VEHICLE RENTER. From here on forth, LOSS shall be interpreted as the vehicle and/or any part of the vehicle and its contents and car keys that are not in the possession of LUXURY CAR RENTAL or THE VEHICLE RENTER in which it was originally in the possession of the aforementioned parties before the vehicle was handed over to THE VEHICLE RENTER.
Payment
A Booking Deposit is required before the confirmation (non-refundable). Full payment is required upon car collection. (Cash or Card or Online transfer only). Security Deposit is required upon car collection (Cash or Online transfer only) and is refundable WITHIN 3 days and Keep RM500 after 11 working days after inspection. Any charges for summons or repairs for damages proven to have incurred during the rental period will be deducted from the security deposit and the balance, if any, will be returned to the vehicle renter.
Usage
The vehicle renter holds the responsibility to ensure that he vehicle is only fueled with the proper fuel. RON-97 Unleaded and above Petrol ONLY for petrol vehicles and diesel for diesel engines. The vehicle renter holds the responsibility to ensure that the vehicle is fueled to the same level as given. Any petrol shortage will be charged deducted accordingly from the security deposit. The vehicle renter holds the responsibility to ensure that the vehicle is NOT used for any illegal activities. The vehicle renter holds the responsibility for any damages done to the vehicle if it is used off the public roads. The vehicle renter is the only person allowed to drive the vehicle. In an event where the vehicle renter allowed another person to drive the vehicle, Jalal Creative has the right to cancel the rental and confiscate the deposit.
Loss or Damage
(1) The vehicle renter holds the responsibility to ensure that the vehicle is returned to the agreed location on time in an undamaged condition.
(2) The vehicle renter holds the responsibility to inform Jalal Creative Solution Sdn Bhd of any accidents, damages or irregular behavior of the vehicle immediately. Failure to do so will render the vehicle renter responsible for the repair and towing cost regardless of whether the damages are caused by the vehicle renter or others.
(3) The vehicle renter is held responsible for any loss or damage to the vehicle within the rental period.
(4) In the event of an accident with another vehicle at fault, the vehicle renter may opt to claim damages from the owner/driver of the vehicle at fault.
(5) In the event of an accident due to the negligence of the vehicle renter, the vehicle renter is held responsible for
the vehicle’s repair charges up to a maximum amount stated in accordance to the vehicle grouping (refer to CDW and Insurance). If the renter did not opt-in for CDW, the renter is responsible to pay for both the rental fees while vehicle is in repair and the repair cost of the damages. All the repair must be done at Jalal Creative Solution authorized workshops.
(6) In the event of a major accident or total lost, the vehicle renter is held responsible for the losses to the vehicle due to the vehicle being in a workshop up to a maximum amount stated in accordance to the vehicle grouping (refer to CDW and Insurance). If the renter did not opt-in for insurance, the renter is responsible to pay for both the rental fees while vehicle is in workshop or until the insurance company compensate Jalal Creative Solution for the vehicle lost and the repair cost of the vehicle.
(7) The vehicle renter will be held responsible for the loss of keys while under the rental period and its replacement cost up to a maximum amount stated in accordance to the vehicle grouping (refer to CDW and Insurance).
(8) While the vehicle is in repair, the renter has to also pay the rental fees of the vehicle until the vehicle is totally repaired and returned to Jalal Creative Solution Sdn Bhd.
(9)In the event where the vehicle was too dirty (e.g. smoke, burned interior, durian, and others) and cannot be cleaned by the standard cleaning service, the renter has to pay for the extra cleaning fees.
(10) In the event where the vehicle is held by the authority, Police, Court or otherwise, the renter has to continue pay rental fees of the vehicle until the vehicle is returned back to Jalal Creative. Any damages to the vehicle after returning will be the renter responsibility to repair.
(11) Any delayed rental fees will be subjected to 10% interest rate compound monthly.
CDW and Insurance
All Jalal Creative Solution Sdn Bhd’s vehicles are insured. In the event of any major accidents which may or may not result in the vehicle being deemed a total loss, the vehicle renter holds the responsibility to bear the costs of repairs or claims also bear the fees for rental. Jalal Creative Solution Sdn Bhd provides a Collision Damage Waiver (CDW) to assist in lowering the burden of costs on the vehicle renter. Depending on the vehicle grouping, the vehicle renter only has to pay damages up to a certain amount as stated in the table below in accordance to the vehicle grouping. In the event of a major accident, the vehicle renter holds the responsibility to pay damages of 100% of the base rental rate for as long as the vehicle is in the workshop and still under repairs up to a certain amount as stated in the table below in accordance to the vehicle grouping. In the event the vehicle is deemed a total loss, the vehicle renter holds the responsibility to pay damages of 8 months of the base rental rate up to a certain amount as stated in the table below in accordance to the vehicle grouping. The maximum amount the vehicle renter is liable for in each vehicle group is stated in the table below
Accidents
The vehicle renter holds the responsibility to inform Jalal Creative Solution Sdn Bhd of any minor or major accidents instantly. Failure to do so, will result in making the renter responsible for all the damages related to the incident. The vehicle renter is NOT allowed to engage the services of any unauthorized call-men or tow trucks in the event of an accident. Should the vehicle renter engage the services of any call-men or tow trucks, the vehicle renter holds the responsibility to pay any amount asked by the unauthorized third-party call-men or tow trucks to reacquire the rental vehicle from the third-party possession. The vehicle renter holds the responsibility to acquire the names and details of all parties involved in the accident and witnesses. The vehicle renter shall not abandon the rental vehicle in an environment deemed unsafe to a reasonable person.
Breakdown Support
In the event of Car Breakdown, the vehicle renter may contact Jalal Creative Solution Sdn Bhd (0129221110) 24-hour helpline immediately to enable Jalal Creative Solution Sdn Bhd to assist. A replacement vehicle of the same value may be provided subject to availability. Any damage due to the negligence of the vehicle renter such as a punctured tyre due to negligent driving, loss of keys, dead battery due to the vehicle renter’s negligence and such shall incur a surcharge of RM200 if assistance from Jalal Creative Solution Sdn Bhd is required. The vehicle renter shall also hold the responsibility to bear the costs of replacing the dead battery, loss keys or damaged tire.
Rental Alternatives / Cancellation
Jalal Creative reservesthe rightto cancel any rental priorto commencementfor any reason whatsoever. Jalal Creative may, if itso chooses,recommend an alternative vehicle to the vehicle renter, preferably of the same category. Should the vehicle renter decide not to accept the alternative, all monetary payments made by the vehicle renter will be refunded in full without further obligation orliability on the part of Jalal Creative Solution Sdn Bhd. Jalal creative has the right to cancel the rental during the usage of the vehicle at any time without prior notice if Jalal Creative does not feel comfortable or unsafe. Renter can claim rental fees from the days he/she did not use the vehicle and has already paid for them. If the vehicle renter decided to cancel their rental after starting using the vehicle, the customer is not entitled for any refund for the remaining unused days. Jalal Creative is not required to giving any refund or discount for any unused days should the vehicle renter decided to return the vehicle earlier than end of rental period.
Late Payment Penalty/Retrieval Costs
If the payment for extension on rental is not received within 2 hours from the agreed payment date, the vehicle will be retrieved from the vehicle renter and the vehicle renter holds the responsibility to bear all retrieval costs including towing, labor costs and petrol costs etc. Past due accounts are eligible to be passed to RAM Credit Information Sdn. Bhd. (RAMCI) for recovery purpose. Accounts passed to RAMCI will be listed on their Trade Bureau database. This listing may impact the ability of the customer to secure further credit facilities. Jalal Creative will also pass the vehicle renters information to the Credit Tip-Off Service (CTOS) to be blacklisted from further business with Jalal Creative Solution Sdn Bhd and its associates. Jalal Creative has the right to change the rental fees from monthly or weekly to daily rental rate in an event where the customer has not paid the rental fees in full or delayed payment more than the agreed time.
